Transfer and transplant of human organs law in the participatory legislation forum
Over a two-day the forum of legislation participated in a discussion, which was organized by the Cairo Center for Civic Education& Development, with the sponsorship of the Organization of Konrad Adenauer in cooperation with the "Reform & Development"Party. The discussion was about the new law of transfer and transplant the human organs. The Health Committee is preparing to discuss it during this month of March. Throughout the workshop the forum reviewed all the visions on the draft of the law which executed a lot of debates. It was presented to the Parliament more than once and it was never approved for more than one reason, may be the most important reason is the dispute between the doctors and some of the religious men, specially the debate about the death of the brain stem and the fear that transferring and transplanting human organs would become a trade.
Dr. Murtagy Negm, the one who is responsible of the governmental hospitals and Dr. Mohamed Helal, General Manager of "El Sahel" hospital; started the discussions with a speech about the role of the country to bear the expenses of the liver transplant, which began in Egypt from 2001 in some private hospitals.
Dr. Mohamed Helal affirmed that in Egypt the delayed of the necessary legislation of transferring and transplanting human organs made us back warded form some of the neighboring countries. Adding that the waiting list of patients in need of liver transplants have become large and the treatment is costly which is a great burden on both the country and the patient.
Dr. Amr Wardani a member of Dar El Efta'a talked about the respect of human dignity in the Islamic Legislation and the importance to make sure that his organs do not become a commodity to be bought and sold. It was agreed by. Dr. Ashour El Sayed Romeih, professor of the digestive system and liver surgery, with Dr. Amr Wardani in the irrelevance of death in the stem of the brain, stressing the need of the accompanying of some sensory phenomena of death.
Disagreed with many of the participants in the workshop to this view point and felt that transferring organs after occurring the sensory symptoms of death becomes useless and can not be used at all.
All attendants agreed on the importance of a law to criminalize the transfer of the sexual and reproductive organs, as some countries began experiments in that field.
Dr. Ezzat Serageddin, director of the dialysis unit in Tala Hospital, affirmed the importance to regulate the conditions of the donation, especially as the reports of kidney theft and trading in human organs has become alarming .he also referred to the high cost of dialysis and the difficulty the patients encounter to continue washing due to the complexity and fatigue felt by the patient during the process of washing. He also emphasized that kidney transplantation in Egypt is now advanced to a large extent and we need to establish the law of organ transplant in order to help patients regain their health and their lives normally.
The speech came to Anwar Esmat Sadat,founder representative of Reform and Development Party,about the importance to submit a law concerns the transferring and transplanting of the organs as soon as possible,so that many patients with kidney failure,liver cirrhosis, hepatitis C and those who are in need of transplanting of the cornea would restore their sight and achieve their hope in healing.
Emphasizing the role of civil society in supporting the legislations the citizens required and to participate in its discussion, noting that while discussing the law, to take into consideration the poor and those who can not afford treatment.
Essam al-Arian, representative of the Association of Doctors, during the workshop advised that both the union and all the doctors are supporting the law of transferring and transplanting organs. He confirmed that there is no religious dispute on that law, as it is important to prioritize the public benefit, taking into account the humanitarian aspect of the patients who are waiting for a pending law through years ago. He confirmed that doctors agree among themselves about death of the brain stem.
Fahim Saad, a Coptic priest of the Archbishop at El Monoufia Chpin El Kom, spoke about the law, stressing that the Christian religion is spreading love and that organ donation was a kind of love that God imposed on the human beings, noting that the unity and interdependence of human beings is the way of happiness in this world and the afterlife.
The Forum has concluded its discussions with some recommendations. The most important one was to submit this law of the transfer of organs the soonest possible, especially taking into account the humanitarian aspects of the cases and the poor as well as the vision of both the Muslim and Christian spokes-men. Also, to take into account the criminalization of trading in human organs, and the Forum would select five participants in the symposium to attend the debate about submitting law in the Parliament.
